No End to Sexual Atrocities - Is Modi's  Nari Sakti self delusion/self deception!

 

                No end to sexual atrocities being reported in the media. Going by the escalating incidence, the real issue to address: "Is India a Diseased Civilization".  Is Modi's  Nari Shakti self delusion/self deception!

 

                Four cases against women are making the headlines over the past one week to include: Sonali Phogat in Goa; Ankita Kumari in Jharkhand; and  Kalikurchi in Tamil Nadu.

 

                One, Sonali Phogat, (real name Sonali Singh), aged  42, a former TikTok star and contestant on the reality show Big Boss, who died on 23 August 2022, was declared dead due to heart attack by the doctors. However, on 25 August 2022, her autopsy report found that there were multiple blunt injuries over her body but the report didn't confirm the cause of her death.  Her associates, Sudhir Sagwan and Sukhwinder Singh, were arrested by the police. During interrogation, the accused admitted that they had mixed 1.5 gm of MDMA in a bottle before the party.

 

                Two, Ankita Kumari, student of Class 12, the Dumka girl in Jharkhand, was doused in petrol for spurning her neighbor, Shahrukh Khan's, advances and set fire by dousing petrol on her while still asleep  on 23 August 2022. When she woke up with her body in flames, she ran up to family members who attempted to extinguish the fire. Her family then hurried her to the hospital. It was found in the hospital that Ankita had suffered severe burns and died on 28 August 2022.

 

                Three, based on a complaint by NGO Odanadi Seva Samsthe, the Mysuru city police have registered an FIR against Dr Shivamurthy Sharanaru, chief pontiff of Murugha Mutt in Chitradurga, a prominent Lingayat mutt seer and detained on 29 August 2022 in an alleged sexual assault case accused of sexually abusing two minors who were in the hostel which is run by the educational wing of the mutt and studying.  A case has been filed under the Protection from Sexual Offences (POSCO) Act.

 

                Four, a 17-year-old student of class 12 of a private residential school in Chinnasalem, Kallakurichi, Tamil Nadu, was found dead in the hostel premises on 13 July 2022, which made media headlines. As per latest reports, the Madras High Court has ruled it as suicide. But, why suicide by a girl in the hostel?

 

                In all cases, political parties jumped into the fray and indulged in vicious politics. In particular  in Karnataka, the veteran BJP leader and the most influential Lingayat politician in the state, Yediyurappa who said, "There is no truth to this case. Let the investigation go on and the Swamiji will come out clean."   Quite ironic it is that Dr Sharanaru of Murugha Mutt, who is now being supported by Yediyurappa, initiated Rahul Gandhi into Lingayatism, given Lingadeeksha by the accused seer last month and his blessings to Rahul Gandhi during Siddaramiah's 75th birthday celebrations.

 

                Meanwhile, the Seer of the Mutt is roaming free and the girls have been sent for medical examination.

 

               High time for Modi, the Prime Minister, to introspect over his own shortcomings in formulating strict laws and enforcing them without fear and favor. After all, the gruesome atrocities against women continue despite Modi's rhetoric about the role of "Nari Shakti" from the ramparts of Red Fort on 15 August 2022. Jingoistic rhetoric or saber rattling on key issues from the Red Fort is quite easy; but ensuring their observance by "We the People" is most vexatious. Modi stated: "We have been casually using language and words that are insulting to women. Can we not pledge to get rid of everything in our behavior, culture and everyday life that humiliates and demeans women? Women's pride is going to be a huge asset in fulfilling the dreams of the nation. I see this power and therefore I am insistent on it."

 

                Since Nirbhaya's gruesome rape and murder in Delhi, I had written many articles on the key issue contra women's safety and security particularly minor girls. Yet, neither the lawmakers - MPs and MLAs - or judiciary or the law enforcement agencies have woken up to the gruesome atrocities against women. Even the media after sensationalizing incidents retracts. The only way one can explain such a wanton and deliberate callousness and procrastination of all the institutions is that we are in the "Kaliyug Age" and India is a "Diseased Civilization" headed by despicable leaders, mostly criminals and crooks, masquerading as leaders in "Service of Society", including Women.

               

                Let me very briefly reproduce extract of my articles:

 

a)      18 January 2020 - Letter to Ravi Shankar Prasad, Law Minister: Please table a Bill reforming the "Criminal Jurisprudence System" immediately after the President's Address on reopening of the Parliament. Should you fail to do so, it would remain an indelible black mark on the BJP that would cost you politically. ….. 7 categories of rapes includes: 1) Gang rape of minor committed followed by gruesome killing of the victim and burning; 2) Rape of minor followed by gruesome killing of the victim and burning: 3) Gang rape of minor; 4) Gang rape of adult followed by gruesome killing of the victim and burning; 5) Rape of adult followed by gruesome killing of the victim and burning; 6) Rape of adult; and also 7) Rape of veterans. Surely, gang rape committed by a group of criminals against minor and setting fire to private parts and burning the victim to death is more gruesome and the most despicable criminal act.  Add to it, rapes committed by “law makers”! Surely, they must be viewed as most heinous - rarest of rare - and very deterrent punishments must be prescribed in the laws. ... No point for the judiciary in blaming the law makers, who have among them a bunch of criminals masquerading as leaders. And, many lawmakers like Mulayam Singh Yadav, Azam Khan and Akhilesh Yadav justify the most heinous, barbaric and gruesome criminal acts as either “mistakes of boys” or “political mischief” or “blame the dress of girls” and so on.

 

b)      8 Dec  2019 - Collapse of Four Pillars of the Constitution:   Judiciary and Police are facing the public ire following the rape, strangulating and burning the body of Dr. Priyanka Reddy in Hyderabad area and the Unnao rape victim succumbing to 90% burns when she was waylaid by the accused released on bail and dousing her with petrol and burning her. … Due processes of laws are meant for civilized persons; but certainly not for brutal barbarians on the prowl exploiting loopholes or shortcomings in the law and order machinery/criminal justice system.   For God’s and women’s sake, let not anyone view rapes as aberrations in a civilized society…..

 

c)       1 December 2019 - Hullabaloo or outrage over Rape, Murder and Burning of Copse of Dr Priyanka Reddy:  In 2017, Gopalkrishna Gandhi, former West Bengal governor, grandson of Mahatma Gandhi stated “I feel that the death penalty and capital punishment belong to the medieval ages.” Ms Shabna Azmi, claiming to be a liberal, may cry ‘foul’ against capital punishment, particularly in civilized societies. Human Rights activists oppose “death penalty’ for the convicts. Such liberals are living in a ‘fool's paradise’ of make believe and delusional “civilized society” of modern India. If liberals think that they can change the mindset of different layers of society by mere pontification from AC rooms, they are simply ridiculous in their expectations. …….Ipso facto, 'Justice delayed is justice denied' the oft quoted words of William Goldstone best portrays the judicial system prevalent in our country. It means that if timely justice is not provided to the sufferer, it loses its importance and violates human rights………… Usually it is to highlight that such heinous crimes are the consequences of “Systems Failure”. Who is responsible and accountable for “Systemic Failure”? The answer is simple. The President of India, the “Lawmakers – elected representatives”, the judiciary at all levels and the police law and order machinery and processes are squarely responsible for “Systems Failure”. …….  Julio Francis Ribeiro, who led the Punjab Police during part of the Punjab insurgency periods, has reminisced recently in the media “When I was a young student of law, those accused of heinous crimes like murder or rape were tried swiftly and punished or set free, as the evidence on record dictated, within a year. The average time taken was eight or nine months, during which time the accused were in the custody of jailors. The hearings were held daily, and no adjournments were asked for or given.”

 

d)      Rahul Ghandy - Alleged Rape King? 13 Dec 2019: Sukanya's Case

 

e)      Realities of Rapes? 14 April 2018: Kahuta (J & K) and Unnao (UP) rapes/murders have assumed political overtones what with Rahul Ghandy (RG) and the Congress Party doing candle light marches all over the country to score political brownie points over its arch rival Modi and the BJP. Even the UN Chief has commented adversely on the Unnao rape. What are the realities of the scourge of rapes? Modi, the Prime Minister, broke his silence during the inauguration of B. R. Ambedkar Memorial at New Delhi on 13 April 2018 and assured the nation that “no criminal will be spared. Justice will be done. Our daughters will get justice.” My issue with the PM is simple. Is it going to be a time-tested ‘delaying politics’ stratagem? Or, will the PM deliver the promise in a time bound or specific manner? If Modi wants to regain credibility, he must strike decisively at the culprits without any further delay and put them behind bars.

 

f)       Outrage over Murder, Molestation and Rapes: 20 Feb 2017: Media and public anger and outrage over the latest series of crimes against of women – molestation against Kerala actress, murder of a 3-year old after rape in Chennai and rape of a Northeast lady in Delhi – clearly exposes inadequacy of law and order, laws, investigation processes and fast track judicial verdicts. In hindsight, it is abject systemic failure…..Following civil society and media activism after the Nirbhaya incident, the Criminal Law (Amendment) Ordinance, 2013 was promulgated by President Pranab Mukherjee, on 3 February 2013 which provided for death penalty in case of “rarest of rarest rape cases”. ….The sense of ‘time’ – fast tracking – is a joke played out by the political and judicial leadership on the people, particularly the Apex Court….Even then my plea was simple. “Rape is a Rape, Rape…..”  Not only laws must act as deterrent, but also ensure their speedy investigation, trial, appeals and execution. Unless the ‘fear of the law’ is demonstrated to the public at large, rapes will continue to torment the society….. Final verdicts of ‘death penalty’ must be passed by the Apex Court in a time bound manner to send the right signals. In practice, legal procedures, despite claiming to be on fast track mode, have miserably failed to execute sentences…..  What is needed is implementation of judicial process on the lines of on the lines of a “General Court Martial” followed in the Armed Forces to ensure speedy trial and disposal of the case in a time bound manner……It is high time to prescribe time limits for investigation and filing charge sheet, trail, appeal, final verdict and President’s confirmation…..Most importantly, even the final process of appeal to the President for special pardon should be dispensed within a time frame of seven days…..Finally,  execution of “death sentence by hanging”  in full public gaze.

 

g)      Rapes – Insensitive Nation: 4 August 2016: Human rights activists and the so called pseudo liberals vent their ire against ‘capital punishments’.  Why do they remain subdued when gruesome and barbaric acts of rapes against minors followed by murders are committed by criminals? Wake up pseudo liberals, India may claim to be an ancient civilization; but modern India has turned into a ‘barbaric civilization”…..Laws and their processes must have a deterrence effect. Otherwise, they are useless; worse than a tissue paper…..Options are available for making laws. To have a deterrence effect, the final verdict must be passed and acted upon within a specific time frame. At the most, six months for execution of hanging…..In a lesser crime of rape, “Castration” will have deterrence effect. It is high time to enact such a law….. What is the reason? Rape continues to generally cloud public perception – woeful generalization. The fault lies in such a generalized view. Gang rape committed by group of criminals followed by killing the victim is simply “Murder” most gruesome. Rape committed by an adult male against minor’s falls in a different category. Gang rape committed by a group of criminals against minor and setting fire on private parts and burning the victim to death is more gruesome and the most despicable criminal act. All such cases are happening all around during the recent past and highlighted in the media. Yet, there has been increase in the incidents of rapes reported from all corners of the country. What a shame? Why? The reason is simple.  The laws and judiciary have failed miserably to deliver justice in favor of the victims…..No point for the judiciary in blaming the law maker, who have among them a bunch of criminals masquerading as leaders. Also, blaming the police for the abject failure in bringing the cases before the bench. It is quite common knowledge that the police act under the ‘fiat’ of their political masters and they dare not oppose them at the SHO level before they are shunted out…..Political leaders appearing at the door steps of victims to gain photo opportunities does no good. ……Wake up India! Never too late to bring about sanity to claim to be a civilized nation instead of being drubbed as “Rapists Nation”.

i)        RAPE CONTROVERSY – WHO SHOULD RESIGN? 23 April 2013: National media wants the Delhi Police Commissioner to resign owning moral responsibility for the ongoing spate of “Rapes” earning the dubious distinction world over Delhi as the “Capital City of rapes”, particularly after the police response at the SHO level to register the FIR and offering bribes to the relatives of the victim to close the case.

 

          In sum, the extracts are quite explicit. Systemic failure of all institutions is real. No point in delivering sermons and high-fly rhetoric from the ramparts of the Red Fort annually.  Modi must admit the following realities - Kaliyug Age and Diseased Civilization. No point in delivering sermons for they only result in consolidation and advancement of a "Deceived Civilization".

 

              There is no alternative for Modi if he genuinely wants "Nari Sakti" to guide the path of modern India, he must not only pass laws (first ordnance immediately) but ensure time bound disposal of atrocities against women like reminiscence of Julio Francis Ribeiro:  “When I was a young student of law, those accused of heinous crimes like murder or rape were tried swiftly and punished or set free, as the evidence on record dictated, within a year. The average time taken was eight or nine months, during which time the accused were in the custody of jailors. The hearings were held daily, and no adjournments were asked for or given.” Otherwise, Nari Sakti sermon is self delusion/self deception.
